Payment made by you on our website is fully secured and controlled by third party payment gateways. At the time of transaction, you may be asked to provide net-banking or debit/credit card information only for the purpose of carrying out the desired transaction. If the price listed on our website is not correct(Due to mistake) then we may contact you to buy the software at the actual price or cancel the order. We reserves the right to cancel the order and refund the amount even after your order is processed from your side and waiting from our side (SoftwareSME).
If the order has been accepted by the vendor through CRM, you will receive the notification via email.After the acceptance of order it can not be cancelled by you.Such cancellation requests will be treated as product return.
If the order is not been delivered within given time-frame, we shall contact you and advice you for the delay. At that time you shall be entitled to cancel the order and get the full amount refund within 7 working days if the delay time is not acceptable by you.
We cannot accept cancellations over the telephone for security reasons. If you wish to cancel you will have to write an email at info@softwaresme.com and you will hear from us within 1-2 business days after receiving the return request.
For your convenience, We offers a full credit return of merchandise amount for defective and stock balance merchandise return.
Any query related to the Tax invoice should be raised within 7 days. Tax invoice is payable immediately.

Any other taxes if applicable will be charged extra on a later date.

Any event beyond the reasonable control of the Parties, and which is unavoidable notwithstanding the reasonable care of the party affected, and shall include but not limited to war, insurrection, riot, civil unrest, sabotage, boycott, embargo, explosion, fire, earthquake, flood, unavoidable accident, epidemic, act of God, action or inaction of any governmental official or agency (civil or military) and refusal of any licences or permits, if properly applied for. If either Party is prevented from or delayed in performing any of its obligations under these terms of use by an event of Force Majeure, then it shall notify the other in writing of the occurrence of such event and the circumstances thereof within Fifteen (15) days after the occurrence of such event. The Party who has given such notice shall be excused from the performance or punctual performance of its obligations under these terms of use for so long as the relevant event of Force Majeure continues and to the extent that such Party’s performance is prevented or delayed. The occurrence of any event of Force Majeure affecting either party shall not give rise to any claim for damages or additional costs and expenses suffered or incurred by reason of Force Majeure.

You will be subject to the policies and terms & conditions in force at the time, unless any change to those policies or these conditions is required to be made by Law or Government authority. If any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.
In the event of any dispute arising out of or relating to these terms, the affected party shall notify the other party, and the parties shall attempt in good faith to resolve the matter agreed between both the parties. Any disputes not resolved by good faith discussions shall be referred to senior executives of each party, who shall meet at a mutually acceptable time and location within thirty (30) days after the Notice Date and attempt to negotiate a settlement. If the dispute has not resolved through negotiation, it shall be referred to mediation at the office of the SoftwareSME, Faridabad and in accordance with its then-current Mediation Rules and as per the Arbitration & Conciliation Act, 1996. If the mediation is abandoned by the mediator or is otherwise concluded without the dispute or difference being resolved, then such dispute difference or controversy shall be referred to and determined by arbitration by a sole arbitrator as per the Arbitration & Conciliation Act, 1996. Any award so passed by the Arbitrator shall be binding on both the parties. The Venue of Arbitration shall be at Faridabad and the proceeding shall be in the English language. This Agreement shall be governed by and construed in accordance with the laws of India and shall be subject to the exclusive jurisdiction of courts at Faridabad.
